Wrongful Death

A wrongful death lawsuit alleges that the decedent was killed as a result of the negligence (or other liability) on the part of a defendant, and that surviving dependents or beneficiaries are entitled to monetary damages as a result of a defendant's conduct which resulted in the wrongful death.

Wrongful death claims may arise from an accident or intentional act. We employ private investigators and consult with a nationwide network of medical experts, accident reconstruction engineers, human factor experts and other professionals who can testify to the cause of the fatal injury.

At the Law Offices of Michael Handy, our attorneys are cognizant of the pain felt by survivors of a loved one who died because of the negligence or acts of others and offer compassionate representation in wrongful death litigation.

A wrongful death claim is very different from a normal negligence lawsuit. Every State's wrongful death statutes follow the same general principles.  A wrongful death claim generally consists of four elements:

  • the death was caused, in whole or part, by the conduct of the defendant;
  • the defendant was negligent or strictly liable for the victim’s death;
  • there is a surviving spouse, children, beneficiaries or dependents;
  • monetary damages have resulted from the victim’s death.

In seeking to recover wrongful death compensation, our attorneys meet personally with families to learn as much as they can about loved ones and what their loss means to surviving members of the family.  Spouses, children, and parents of wrongful death victims may be eligible to recover damages which can include economic losses such as medical and funeral expenses, as well as non-economic damages for loss of companionship of the family member and emotional suffering.

The Law Offices of Michael Handy offers a no-obligation review of your claim to determine if a case may exist. If we believe a case may exist, we can help you understand the value of your case and how best to proceed. Call us at 1-817-336-4700 or submit your case to us online.
